$3.5 million settlement for a man injured because of defective motorcycle

Brian Kabateck represented Paul Libaridian, a 40-year-old Security systems installer, husband and father of two young children, who was seriously injured when his defective motorcycle stopped functioning on a major Fresno street. While holding the stalled motorcycle, Mr. Libaridian was struck by a 2003 Cadillac DeVille automobile. Mr. Libaridian suffered a cracked skull, facial fractures, a leg fracture, and damage to his knees, requiring four total surgeries and a month of hospitalization. Mr. Kabateck successfully settled the case for the entire applicable insurance policy of $3,500,000. Mr. Kabateck conducted focus group analysis, and made powerful legal and economic arguments, which persuaded the defendant to pay the policy instead of risking a verdict well in excess of the policy.
