$2.85 million settlement awarded to man injured while operating a massive rock crushing machine

Plaintiff, Jose Cortes, was 34 years old when he was catastrophically injured while operating a massive rock crushing facility machine. Mr. Cortes was standing on top of the machine, lost his balance and fell onto a conveyor belt. He was then rendered unconscious and seriously injured by a combination of the fall from the 15’ high machine and being struck by debris while on the conveyor belt. Mr. Kabateck convinced Travelers Insurance Company to settle the case and avoid trial risks for $2,850,000, while also convincing State Fund, the employer’s insurer, to waive any obligation to pay back past medical debt and to provide for all related future medical care.
