SJV Water takes a detailed look at where things stand in Planada three years after the 2023 Merced flood — from homes being rebuilt and millions in relief funds distributed, to the ongoing legal battle over what caused the disaster.
Kabateck LLP represents Planada families in Borba et al. v. County of Merced, which seeks to determine which agencies are responsible for the failure to maintain creek channels that led to widespread flooding. The case has faced delays after the State of California served plaintiffs with thousands of discovery requests. A court-appointed referee recently directed the parties to finalize a damages questionnaire and timeline to keep the case moving.
Managing Partner Shant Karnikian said the firm is also monitoring how disaster relief programs are being administered to ensure they don’t interfere with clients’ legal rights.
“Plaintiffs remain committed to advancing this case and obtaining accountability and justice for the families impacted by the 2023 Merced flood.”
