Kabateck LLP has secured nearly $6 million for a client who suffered a catastrophic knee injury during an off-campus school activity after her professor encouraged her to participate despite her safety concerns.
The client raised concerns about the activity beforehand but was encouraged by her professor to take part and was permitted to do so by the third-party operator. She sustained a catastrophic knee injury as a result.
The case presented substantial legal hurdles. The client had signed a liability waiver, and both the school and the third-party operator moved for summary judgment under the assumption-of-risk doctrine. Kabateck LLP successfully defeated both motions, and the case settled on the eve of trial.
