Disaster Insurance Litigation

KBK represents policyholders in first-party insurance claims for catastrophes that result in loss or damage of health and life. Such disasters include fires, floods, hurricanes, earthquakes, or other major events that may effect loss and for which you are wrongfully denied coverage by your insurance carrier, which is known as bad faith .

KBK attorneys are renowned for their efforts in this litigation area, working hard to understand the insured's policy and what claims the insurance company originally promised, then seeking justice for any promises that have not been honored.

Disaster cases handled by KBK include:

  • KBK continues to investigate and bring suits against insurance companies denying full compensation to Florida property owners who were victimized by the hurricanes of 2004 and 2005.
  • Brian Kabateck represented several hundreds of homeowners, condo owners, and commercial building owners to recover damages resulting from the 1994 Northridge, California earthquake from their insurance companies, including $10 million for the Park Northridge Homeowners Association.
  • Brian Kabateck represented more than 100 homeowners in Hemet, California for damages caused to their homes by daily blasting in the construction of a dam.
  • KBK has represented more than 100 homeowners from a vacation mountaintop community northeast of Tucson in insurance bad faith lawsuits. The plaintiffs claim their insurance companies failed to provide enough coverage on homes destroyed in a June 2003 Mount Lemmon wildfire.
